Terms of Service

These Terms of Service ("Terms") are an agreement between you and Shopwrecked LLC ("Shopwrecked", "we", "us"), the company that operates this website and the AI voice and text agent service offered on it (the "Service"). By creating an account or using the Service you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, our AI Disclosure and our SMS Terms.
1. The Service
The Service gives you an AI agent that you can talk with in your browser and, when phone features are available on your account, by phone call and text message on a number we provide. The agent's replies are generated by artificial intelligence (AI) models from third-party providers.
AI output can be inaccurate, incomplete or out of date. Check anything important before you rely on it, and do not rely on the agent for medical, legal, financial or emergency decisions.
2. Eligibility and accounts
You must be at least 18 years old to use the Service. You are responsible for your account, for keeping your sign-in details secure, and for everything done through your account. You must give us accurate information, including a mobile number that belongs to you or that you are authorized to use.
3. Phone numbers
If we assign you a phone number, it is provisioned and held by Shopwrecked LLC through our telecommunications providers. You may use it while your account is in good standing; it is not transferable, and we may reclaim it if your account closes or the number is used in breach of these Terms.
4. SMS Terms
Program: Shopwrecked Agent Messaging. Your agent sends text messages only to the mobile number you added to your account and consented to receive messages on: replies to your messages and notices about your account and the tasks you gave it. We do not send marketing messages.
Message frequency varies with how you use your agent.
Message and data rates may apply.
Reply STOP to any message to cancel. After you opt out you will receive one final message confirming that you have been unsubscribed, and then no further messages. Reply HELP to any message for help, or contact support@shopwrecked.com.
Carriers are not liable for delayed or undelivered messages.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

5. AI disclosure
Your agent is an AI, not a person. It will identify itself as an AI agent at the start of every conversation it initiates, whether by an outbound call or an outbound text message. When you start a conversation with your agent, by calling, texting or in the browser, we presume you know you are speaking with an AI, so the agent does not need to announce that it is an AI. It will never claim to be human, and it will answer honestly whenever you ask whether you are talking with an AI. See our AI Disclosure.
6. Call recording and transcripts
We do not record calls. Audio is processed live to run the conversation and is not stored by us. We do not store call transcripts. The same applies to voice in the browser: it is processed live, and we do not record it or store a transcript of it.
From a call, we keep only its metadata, and a summary only if you turn on the optional summary feature. The metadata is the time, length and phone numbers of the call, and the usage and cost it generated, so we can meter, cap and bill the Service.
A call summary is sent only if you turn on the optional summary feature. It is a short summary, not a transcript.
We keep call metadata, text messages, browser conversation content, optional call summaries, usage records and consent records for one year, and then delete them, unless we must keep them longer to meet legal or carrier record-keeping obligations or to resolve a dispute. Our Privacy Policy explains our retention in full.
7. Acceptable use
You must follow our Acceptable Use Policy and the usage policies of the AI model providers the Service uses, including the OpenAI Usage Policies and the Anthropic Usage Policy. We may suspend or close an account that breaks them.
8. Your own model keys
If we offer the option to connect your own AI model provider key and you use it, you remain bound by that provider's terms, and that provider bills you directly for its usage. We will store your key encrypted and use it only to run your agent.
9. Fees
Some features may be paid. Any fees, and how they are charged, will be shown to you before you are charged. Taxes and your carrier's charges are your responsibility.
10. Not for emergencies
The Service is not a replacement for a telephone service and cannot be used to reach emergency services. Do not use it to call or text 911 or any other emergency number.
11. Your content
You keep the rights you have in what you say, type or upload ("your content"). You give Shopwrecked LLC permission to process your content only as needed to run, secure and support the Service for you, as described in our Privacy Policy.
12. Suspension and termination
You can close your account at any time. We may suspend or end your access if you break these Terms, if your use creates risk or legal exposure for us or others, or if we stop offering the Service.
13. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, Shopwrecked LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and does not promise that the Service or any AI output will be accurate, uninterrupted or error-free.
14. Limitation of liability
To the fullest extent the law allows, Shopwrecked LLC is not liable for any indirect, incidental, special, consequential or punitive damages, and its total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US $100.
15. Changes
We may update these Terms. If a change is material we will tell you before it takes effect, by email or in the Service. Continuing to use the Service after a change takes effect means you accept it.
